ELITE FUTSAL ACADEMY 805

 

WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK AGREEMENT

 

 

1. Assumption of Risk

 

I understand that participation in futsal, soccer training, strength & conditioning, camps, clinics, scrimmages, tournaments, and related activities conducted by Elite Futsal Academy 805 involves inherent risks. These risks include, but are not limited to, muscle strains, sprains, fractures, concussions, illness, permanent disability, paralysis, or death.

 

I knowingly, voluntarily, and expressly assume all risks, both known and unknown, associated with participation in activities conducted by Elite Futsal Academy 805, including those arising from the negligence of Elite Futsal Academy 805, to the fullest extent permitted under California law.

 

 

2. Release and Waiver of Liability (California)

 

In consideration of being permitted to participate, I, on behalf of myself and/or my minor child, hereby release, waive, discharge, and covenant not to sue Elite Futsal Academy 805, Elite Soccer Performance, its owners, officers, directors, coaches, trainers, employees, volunteers, independent contractors, affiliates, sponsors, and facility owners from any and all liability, claims, demands, actions, or causes of action, including those arising from ordinary negligence, occurring in Southern California or elsewhere, related to participation in programs conducted by Elite Futsal Academy 805.

 

This release does not apply to claims arising from gross negligence or willful misconduct, as prohibited under California law.

 

 

3. Minor Participant Acknowledgment (California Requirement)

 

I certify that I am the parent or legal guardian of the minor participant and have the legal authority to execute this waiver on the minor’s behalf. I agree to indemnify and hold harmless Elite Futsal Academy 805 from any claims brought by or on behalf of the minor participant.

 

 

4. Medical Authorization & Emergency Care

 

I certify that the participant is physically capable of participating in athletic activities. In the event of an emergency, I authorize staff of Elite Futsal Academy 805 to obtain emergency medical treatment for the participant if I cannot be reached. I accept full financial responsibility for any medical care provided. I agree to notify Elite Futsal Academy of any known medical conditions, allergies, medications, or other health concerns that may affect my child’s participation. If none exist, no additional information is required.

 

 

5. COVID-19 & Communicable Illness Disclaimer

 

I acknowledge that participation may expose the participant to communicable diseases, including but not limited to COVID-19, influenza, and other illnesses. I voluntarily assume all risks related to exposure and agree to follow any health or safety guidelines communicated by Elite Futsal Academy 805.

 

 

6. Code of Conduct & Removal Policy

 

I understand that participants are expected to conduct themselves in a safe, respectful, and sportsmanlike manner. Elite Futsal Academy 805 reserves the right to remove any participant whose behavior is deemed unsafe or disruptive, without refund.

 

 

7. Photo, Video & Media Release

 

I grant permission for Elite Futsal Academy 805 to photograph and/or record the participant and use such media for promotional, educational, or marketing purposes (including social media, websites, and printed materials), without compensation.

Parents/guardians who do not consent to photo or video usage must notify Elite Futsal Academy 805 via email at elitefutsal805@gmail.com prior to participation.

 

8. Governing Law & Venue

 

This agreement shall be governed by and interpreted in accordance with the laws of the State of California, with venue for any legal action located in Ventura County, California, unless otherwise required by law.

9. Severability

 

If any portion of this agreement is found unenforceable, the remaining sections shall remain in full force and effect.

10. Agreement 

 

I acknowledge that I have read this waiver carefully, understand its contents, and voluntarily agree to be bound by its terms.
